§ 1.04.010. Definitions.

  • As used in this Code, the following definitions apply:

    Agent means a person acting on behalf of another.

    Child means a person under 18 years of age.

    City means the City of Longmont, Colorado.

    Code, unless otherwise specifically stated, means this Municipal Code.

    Council means the city council of the City of Longmont.

    Declaration means a written document executed by the city manager that declares an emergency.

    Disaster means the occurrence or widespread or severe damage, injury or loss of life or property resulting from any natural or human cause including, but not limited to, lightning, wildfire, wind, blizzard, geological hazard, hurricane, flood, building or structural collapse or failure, epidemic, utility emergency, sudden and severe energy shortages, snowstorm, ice storm, windstorm, hazardous substance spill, chemical or petroleum spill, biological material release, radiological release or spill, public health emergency or accident.

    Emergency means any occurrence or threat of an event or series of events of major proportions, in which the safety and welfare of the inhabitants of the city or their property are jeopardized or placed at extreme peril and in which timely action to avert or minimize damage is essential.

    Employees. Whenever reference is made in this Code to a city employee by title only, this shall be construed as though followed by the words, "of the City of Longmont, Colorado."

    Fee means a sum of money charged by the city for carrying on a business, profession or occupation.

    Hereafter means any time after the section takes effect.

    Hereto means any time previous to the day of when the section in which it occurs takes effect.

    License means the permission granted for the carrying on of a business, profession or occupation.

    Livestock has the same meaning as in the Colorado Pet Animal Care and Facilities Act (C.R.S. § 35-80-101 et seq.).

    Negligent, as well as "neglect," "negligence" and "negligently," means and imports a want of such attention to the nature or probable consequences of the act or omission as a prudent man ordinarily bestows in acting in his own concern.

    Nuisance means any state of things prohibited by the provisions of this Code or by state statute as a nuisance, or anything offensive or obnoxious to the health and welfare of the inhabitants of the city, or any act or thing repugnant to, or creating a hazard to, or having a detrimental effect to a neighborhood or to the community.

    Occupant, applied to a building or land, means and includes any person who occupies the whole or any part of such building or land, whether alone or with others.

    Offense and violation mean any act forbidden by any provision of this Code or the omission of any act required by the provisions of this Code.

    Officers shall be construed as though followed by the words, "of the City of Longmont, Colorado" when this Code refers to a city officer by title only, unless otherwise expanded.

    Omission means a failure to perform an act which is imposed by law or ordinance.

    Operator means the person who is in charge of any operation, business or profession.

    Owner, applied to a building or land, means and includes any part owner, joint owner, tenant in common, joint tenant or lessee of the whole or in part of such building or land.

    Person includes the singular and the plural, and also means and includes any person, firm, corporation, association, partnership or any other form of association or organization.

    Personal property means and includes every description of money, goods, chattels, effects, evidence of right in action and all written instruments by which any pecuniary obligation, right or title to property is created, acknowledged, transferred, increased, defeated, discharged or diminished, and every right or interest therein.

    Pet animal or household pet means an animal that licensed pet animal facilities may lawfully sell under the Colorado Pet Animal Care and Facilities Act (C.R.S. § 35-80-101 et seq.), owned or kept for personal companionship or protection or for sale to others for such purposes, with the following exceptions:

    A.

    Skunks, nondomestic cats, wolves and other wild canine species, poisonous reptiles, bears, raccoon and livestock are not pet animal or household pets; and

    B.

    A domesticated Vietnamese pot-bellied pig weighing less than 95 pounds is a pet animal or household pet, not livestock, if registered with the Goldstar Registry or the Pot-bellied Pig Registry, Inc., or if a veterinarian, properly licensed in Colorado, certifies it is a Vietnamese pot-bellied pig.

    Public place means a place to which the public or a substantial number of the public has access, and includes, but is not limited to, highways, transportation facilities, schools, places of amusement, parks, playgrounds and the common areas of public and private buildings and facilities.

    Retailer, unless otherwise specifically defined, shall be understood to relate to the sale of goods, merchandise, articles or things in small quantities, direct to the consumer.

    Street means and includes alleys, lanes, courts, boulevards, public ways, public squares, public places and sidewalks.

    Tenant, applied to a building or land, means and includes any person who occupies the whole or any part of such building or land, whether alone or with others.

    Wholesaler and wholesale dealer, unless otherwise specifically defined, are understood to relate to the sale of goods, merchandise, articles or things in quantity to persons who purchase for the purpose of resale.

    Writing or written. Any direction in this Code that does or may require anything to be done in "writing" or be "written" is construed to include "printing, printed or partly written and partly printed."
