§ 2.20.120. Rules and regulations—Promulgation power of city manager.

  • A.

    The city manager, or the city manager's designee shall have the power to promulgate in writing such rules, regulations and orders as are reasonably necessary for the following:

    1.

    The protection of life and property within the city or on city-owned or city-leased property outside the city from the dangers created or increased by a disaster or an emergency;

    2.

    A coordinated, efficient, economical program of disaster and emergency preparedness, which shall be titled the emergency preparedness plan.

    B.

    The city manager shall:

    1.

    Present the emergency preparedness plan periodically to the city council;

    2.

    Have the authority to declare and cancel states of disaster and emergency;

    3.

    Cause the prompt filing with the city clerk of declarations, continuations and cancellations of disasters and emergencies. The city clerk shall give such declarations, continuations and cancellations prompt and general publicity. At the time of declaration, the city clerk shall make a reasonable attempt to notify the city council of an emergency declaration and that notification shall, at a minimum, contain a cause, extent and general description of the emergency, the actions to be taken, and the expected duration;

    4.

    Request the consent of the city council to continue a state of disaster or emergency in excess of seven days.
