§ 2.20.130. Immunity from liability for emergency preparedness activities.

  • All activities and duties authorized in sections 2.20.100 through 2.20.130, and all things done pursuant to the rules and regulations promulgated for emergency preparedness purposes as authorized in this chapter, are declared to be the exercise by the city of its governmental function and neither the city, its officers, authorized persons and organizations, nor the agents, employees or representatives of any of them, while engaged in any emergency preparedness activity or while complying with the provisions of sections 2.20.100 through 2.20.130 or any rule or regulation promulgated pursuant to section 2.20.120 of this chapter, except in case of willful misconduct or as otherwise provided, shall be liable for the death of or any injury to person or damage to property as result of such activity. The provisions of this section shall not affect the right of any person to receive a benefit to which that person would otherwise be entitled under applicable laws of the city or state, or federal statutes.
