§ 9.04.140. Abatement—Duty of officers generally—Right to enter property.

  • The police chief or any Longmont police officer, or such other officer as may be designated by the city manager, shall ascertain and cause all public nuisances declared to be such by this or any other provisions of this Code to be abated. If practicable, such officers may initially request the owner or occupant for permission to enter private property not then open to the public for purposes of inspection and abatement enforcement. Otherwise, unless an emergency is found to exist, resulting in exigent circumstances, such officer shall obtain a search warrant as provided for in Rule 241, municipal court Rules of Procedure.
