§ 3.04.440. Inability to perform—Termination of employee.

  • Subject to sections 3.04.580 and 3.04.590, and applicable administrative regulations for pre-termination conferences, the employee's executive director may terminate an employee's employment due to inability, mental or physical, to perform the essential functions of the employee's job, even with reasonable accommodation.
